We invite you to study the facts hereafter and judge for yourself that such a CASE OF BLUNT THEFT<\/u> <\/em>(Breach of contract) & BLATANT DISGRACE TO THE PROFESSION<\/u><\/em> violates all ethical rules and conventions in the recording industry. Shanachie’s offence calls for intervention on a priority level, either<\/p>\n

– <\/em>by public information via the medias,
\n– by warning concerned organisations such as producer-associations etc.,
\n– by boycott of radio and\/or TV or
\n– by sanctions from copy-right institutions (Harry Fox, BMI etc.)<\/p>\n

Only by this means more damage can be prevented, and those who are finally the ones representing the sole existential grounds of such industry may be protected in the future.<\/p>\n

If there is anybody out there that want to take this particular issue further, we gladly submit you all the individual pages mentioned hereafter.
\nFrom our side, we decided to abandon this dirty business with disgust and concentrate on music only. Hence, our productions are not found anymore on the standard circuit but only via a few exclusive friends who run little distributions and – of course – on this very homepage!<\/p>\n

Since beginning of the relation between Shanachie (interlocutor: Randall Grass) and Mensch, Shanachie is acting entirely against written mutual licence agreement. Punctual answers are delayed; precision in accounting is lacking, transparence is blurred, obviously to by-pass contractual obligations. Despite repeated requests, Shanachie has never provided an adequate royalties-statement…………………………………………………………………………………………………..1<\/p>\n

Instead Shanachie only and ever reverts with the classical delaying tactic: soon, within shortly, at given time etc.<\/p>\n

Now, enough is enough!<\/p>\n

Early 1991, Mensch Music released from its workbench a limited and numbered CD (500 copies) on the internal house label Mensch Records with 16 preliminary<\/em> tracks:<\/p>\n

The CD “PEENI WAALI” was sent as promo to potential licencing partners.
\nEventually, Shanachie manifested interest (june 3, 1991)……………………………………\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 4<\/p>\n

After detailed discussions, on June 1, 1991 a preliminary contract<\/em>………………………..\u00a0\u00a0\u00a0\u00a0\u00a0 5
\nwas established. After several revisions a final licence\u00a0 <\/em>was mutually
\nsigned early 1993 ………………………………………………………………………………………….\u00a0\u00a0\u00a0\u00a0\u00a0 6<\/p>\n

Between preliminary scetch and final contract, several points were
\namended such as:<\/p>\n

Shanachie agrees in writing (september 4, 1991)…………………………………………… 8
\n1. the orignal 16 track CD (limited Mensch pre-release for Promo) is
\nshortened down to 13 tracks, i.e. 3 of the bonus-tracks will be left
\nout.
\n2. “Tr\u00e8s Gai” is substituted by another track.<\/p>\n

On October 24th 1991 tapes and lithographies (13 tracks and relative
\ndetailed technical data-sheet) is despatched by registered mail…………………….\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 9
\n\u00e0Cost of these USA-specific design and mastertape = 2 people, 4
\nmonths work: Sfr. 40’000.–
\n\u00e0The american release cannot<\/em> and will not<\/em> be identical to the limited edition
\nof 16 tracks.<\/p>\n

1st breach of contract:<\/u><\/strong> Shanachie releases a<\/p>\n

I.) vulgar\u00a0\u00a0 B O O T L E G<\/strong><\/p>\n

instead (as specified per indications of October 24th’s despatch) a re-
\nlease with 13 tracks, Shanachie has solely copied Mensch’s limited CD
\nand releases SH 5002 with 16 tracks, avoiding by this to manufacture
\ngenuine tools…………………………………………………………………………………………………\u00a0\u00a0\u00a0\u00a0\u00a0 9
\nHarry Fox (USA) and Washington have been notified of such on
\nJuly 2nd 92, resp. may 22nd 1992…………………………………………………………….\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 12<\/p>\n

 <\/p>\n

\u00e0 Shanachie’s ‘Peeni Waali’ SH 5002<\/strong> with 16 tracks is not<\/em> acceptable<\/strong>
\n(see respective mention in the final licence contract of early 93)…………………….\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 6<\/p>\n

Shanachie pretends to have lost the mastertapes and relative documents
\n(see 9). A second set of same has been despatched on May 22nd 1992 per
\nspecial fast delivery courier. At the same time, Shanachie is unambiguously
\nadvised not to press any further SH 5002 with the 16-tracks-tools.<\/strong> For
\nthis reason, Shanachie has been instructed to return tapes (Umatic 1630)
\nand stamper of the illfated bootleg……………………………………………………………………\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 17<\/p>\n

Caracteristically Shanachie remains evasive from July 92 until February 93
\nand then announces to have lost the second set, too (…)!……………………………………\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 16<\/p>\n

Based on the royalties-statements (see II.)………………………………………………………\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 19
\nit becomes obvious that Shanachie did press bootlegs a second time.
\n<\/strong>Shanachie’s first statement testifies 3’374 pressed units. The following two
\nstatements show that 4’709 units have been sold.
\nShanachie has been repeatedly invited to return those tools in order to
\navoid more bootleg pressings. However, only in June 93 the Umatic tape is
\nreturned but not <\/em>the stamper. Instead, a handwritten notice of printing plant
\nDenon is joined, stating that supposedly the stamper (metal parts) have
\nbeen destroyed and that it isn’t to Denon’s policy to return the customer’s
\nmaterials… (I beg you pardon!…)……………………………………………………………………..\u00a0\u00a0\u00a0\u00a0\u00a0 18<\/p>\n

Since such practices are not acceptable and the scrapping procedure even
\nless controlable, Denon has been asked several times to render evidence
\nof such. No answer has ever been received.<\/p>\n

2nd breach of contract:<\/u><\/strong>…………………………………………………………………………………\u00a0\u00a0\u00a0\u00a0 11<\/p>\n

II.) mecanical rights are not paid by Shanachie<\/strong><\/p>\n

Based on this first gross breach of contract, several points of the licence
\nhave been re-negotiated, amongst which new agreements on the
\nmechanical rights distribution.<\/p>\n

On August 3rd 1992, Shanachie confirms in writing, that the situation of
\nmecanical rights is now clear to them…………………………………………………………… 10
\nand it is agreed in the final licence (early 93) that
\nall mecanical rights are included except<\/p>\n

It has been agreed, that royalties are paid in US$ per pressed unit and not
\nin % per sold unit. As of today, Shanachie keeps forwarding statements in
\n% \u00e0 this lack of transparence renders the fact obvious that by blurring
\nprecise indication on pressed quantities, Shanachie is trying to skip royalty-………….\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 7
\npayments. i.e. if no mecanical rights are paid, it cannot be proved how
\nmuch units were pressed and consequently how much Shanachie owes
\nMensch…………………………………………………………………………………………………………\u00a0\u00a0\u00a0 2<\/p>\n

Without pressure (i.e. repression!) and intervention, and as long as the tools of first pressing
\nare not taken away from Shanachie’s pressing plant (Denon?), further
\nbootlegging must be expected.<\/p>\n

3rd breach of contract:<\/u><\/strong>………………………………………………………………………………….\u00a0\u00a0\u00a0\u00a0 13<\/p>\n

III.) agreed quantity (150 cassettes and 150 CD’s) is not remitted<\/strong><\/p>\n

Point E. of the final licence grants that Shanachie sends Mensch free of
\ncharge<\/em> a quantity of 300 units (SH 5002).<\/p>\n

As of today, only 45 units have reached Mensch (with shipping costs to be
\npaid by Mensch Music…)<\/em>…………………………………………………………………………………\u00a0\u00a0\u00a0 14<\/p>\n

Shanachie has asked for promo 1’200 units to be free of royalties. Now, if
\na concrete study of published reviews is made, Shanachie has triggered
\na mere 6 articles. Many of the american reviews were originally already set
\nby contacts and promo deliveries of Mensch. As a comparison: Mensch
\nhas achieved with its promo a hefty 74 articles!
\n\u00e0 a) Shanachie has not made any state-of-the-art promo
\nb) Shanachie has used the 1’200 units for pure sales
\nThis fact may be explained by the number of sales (see 1), not withstanding
\nstill, that no mecanical rights are scheduled to be paid for these 1’200
\nunits and that, even taking in account these promo units in Shanachie’s
\nfallacious statements, there has been more bootlegs pressed!<\/p>\n

And on top of that it shows that a record company can do all that in impunity before
\nSuisa\u2019s total incompetence and not acting as it should with its affiliate partner Harry Fox (N.Y.)<\/p>\n
